The European Commission’s proposed offshore oil and gas safety legislation aims to tackle the lack of a harmonised safety regime for the EU‑wide industry. It also aims to cut the chances of a major accident or to limit its consequences. If enacted, it will put more responsibility on owners, operators, member states and the Commission. Both industry and regulators in the UK have expressed serious concerns about the potential for the legislation weakening the effectiveness of existing offshore safety regimes in the North Sea. Here we look at the Regulation’s scope and potential implications for the offshore industry. (November 2011)

The German government notified the draft of the first State Treaty amending the State Treaty on Gambling (New State Treaty) on 15 April 2011 to the European Commission under Directive 98/34/EC. In a rather extensive opinion, the Commission declared on 18 July 2011 that European law is being infringed. The Commission has asked the federal states (Länder) to explain and justify their position further. This briefing examines what the Commission has criticised and looks at what will happen next. On 6 April 2011, the heads of the federal states (Ministerpräsidenten der Länder) decided that the existing gambling regime in Germany will be revised to admit certain forms of sports bets offered by private operators, as well as certain internet activities. The existing separation between lotteries and sports bets will, however, be maintained. Only the latter will be subject to a system of seven concessions valid nationwide. The revised law (Erster Glücksspieländerungsstaatsvertrag) is intended to become effective on 1 January 2012. (June 2011)

Die von der deutschen Bundesregierung beschlossene »Energiewende« wird den deutschen Energiemarkt nachhaltig verändern. Der Gesetzgeber hat in diesem Sommer eine Vielzahl von Gesetzen erlassen und damit begonnen, die beschlossenen Maßnahmen durch erhebliche Änderungen des regulatorischen Rahmens umzusetzen. Investitionen in bestimmte Erneuerbare-Energie-Anlagen, Energiespeicher sowie Stromnetze sollen durch die Änderungen des regulatorischen Rahmens begünstigt werden. (September 2011)

Das europäische Emissionshandelssystem bildet seit dem Jahr 2005 eine Insellösung bei den globalen Anstrengungen zum Klimaschutz. Europäische Unternehmen der Energiewirtschaft und Industrie werden erheblichen Belastungen und Wettbewerbsnachteilen ausgesetzt. Dessen ungeachtet sollen in der dritten Phase (2013 bis 2020) ehrgeizige Reduktionsziele durchgesetzt werden. Nur noch Anlagen des Industriesektors werden in begrenztem Umfang kostenfreie Zuteilungen von Emissionsberechtigungen erhalten. Alle wichtigen Detailfragen der Zuteilungsregeln werden in einem kürzlich veröffentlichten EU-Kommissionsbeschluss geregelt. In dieser Information werden die Kernpunkte des zukünftigen Zuteilungsregimes näher erläutert und analy-siert. (September 2011)

Hersteller von Konsumgütern drohen neue Belastungen durch eine Verschärfung des Verbraucherinformationsgesetzes (VIG). Ende Juli hat das Kabinett einen Entwurf zur Änderung des VIG (RegE) beschlossen, der den Anwendungsbereich des Gesetzes auf nahezu alle technischen Verbraucherprodukte ausdehnt, die Auskunftsrechte der Verbraucher erweitert, den Rechtsschutz verkürzt und im Endeffekt zu einer Offenlegung von Betriebs- und Geschäftsgeheimnissen führen kann. Die Bundesrepublik Deutschland hat am 15. April 2011 gemäß der Richtlinie 98/34/EG den Entwurf eines Glücksspieländerungsstaatsvertrags (GlüÄndStV) der Kommission notifiziert. Am 18. Juli 2011 hat diese in einer sehr ausführlichen Stellungnahme erklärt, dass ein Verstoß gegen Unionsrecht vorliege. Sie fordert die Länder zu Nachbesserungen und Erläuterungen auf. (Juli 2011)
